Our jury consulting services have undergone a significant transformation during the past few years. In the old days, our clients called us at the completion of discovery or on the eve of trial asking for assistance with a focus group or mock trial project. In many ways, that old model was akin to crisis management. The evidence and expert reports were gathered, mediation failed, and we were called in to assist the trial team as they ramped up activities for trial.
Because most cases are now being prepared for trial with an eye toward settlement, many of our long term clients have been engaging us much earlier in the litigation process. In the Pre-discovery Phase our clients ask us to conduct venue analyses and provide recommendations about choice of venue, offer advice about the demand for a jury trial, and conduct a Winnability Assessment ® of the case. In the Discovery Phase our clients now ask for assistance with witness preparation and case theme development before deposition testimony begins.
