Discovery Activities

Once the discovery process begins, we are often called to provide assistance with witness preparation activities, the development of case themes to be pursued during discovery, and conceptual development of graphics for expert testimony.

 

 

 

Because video depositions are now the norm, it is important to prepare witnesses for deposition testimony that will be shown at trial.  Once ineffective testimony has been videotaped, it becomes more challenging to repair the damage at trial.  Consequently, many of our clients now retain us to assist them in preparing witnesses for their deposition testimony.

Our understanding of verbal and nonverbal behavior that jurors rely on to make judgments of honesty and deception makes us uniquely qualified to assist in this process.  We can consult with you about trial strategy and the role of each witness in the overall case presentation.  In one recent case, the deposition testimony was so effective that the plaintiff decided not to pursue the case. Although that is the exception, not the rule, thorough preparation of witnesses for their depositions helps to minimize the credibility problems at trial. 

 

 

Case themes are the roadmap for the discovery process.  Fact and expert witnesses benefit from an understanding of the themes that will be pursued in the case, and lawyers taking deposition testimony of opposing witnesses should have a unified approach.  We provide consulting advice about persuasive case themes and how they can be successfully developed through discovery.
