We realize that you have a number of options when selecting a consulting firm to assist with the preparation of your case.  We also realize that there are several characteristics of our consulting services that distinguish us from the competition.

We learn the details of your case and gain an understanding of the strategic opportunities and points of vulnerability.  We work with you to refine case themes and frame the presentation of critical evidence to enhance your persuasive influence at trial.  These consulting activities become an integral part of the engagement.  Indeed, if you are only interested in someone “hosting” a mock trial, then we may not be the right choice for your needs.

We are able to get up to speed quickly on case issues and we work closely with you to develop balanced case presentations that fairly reflect the anticipated trial presentations.

Following our case briefing and consultation on case themes, we will be in a position to develop the case presentations for use in the jury research.  In many cases our clients ask us to develop the initial draft of the case presentations as a means of obtaining our recommendations for the organizational structure of issues and evidence in the case. 

we understand how to tailor a research design that will conform strictly to the scientific method, while meeting your specific case needs.  We have the flexibility to employ a variety of research designs without compromising the integrity of the scientific process.

We routinely talk with our clients about the importance of conducting research projects with larger samples.  The larger the sample, the less sampling error there is in the data and the more stable the findings become.  For example, increasing the number of research participants in your study from 25 to 50 reduces the sampling error by 30 percent!

In addition to sample size, Trial Analysts takes great pride in sampling respondents who are representative of the venire.  We use great care and precision in developing the sampling frame and work closely with local market research firms to screen and recruit respondents who will provide reliable feedback about your case.  In short, our respondents will reflect the socio- economic, educational, employment, racial, and attitudinal characteristics of a typical jury panel in the trial venue. 

In addition, we provide a thorough written analysis of the venue complete with a description of any business trends or pertinent information regarding news events in the area that may influence jurors and your case. 

You will not receive a “data dump” of every piece of information collected during the research.  Instead, we analyze the data and cull the most significant findings to prepare a summary of key issues.  Perhaps most important, we confront the question of why.  Instead of relying entirely on a descriptive account of the findings, we apply our knowledge of Communication Theory and Social Psychology to explain why respondents formed their impressions and judgments about your case.  Understanding why jurors form their judgments enables us to make strategic recommendations for improving the persuasiveness of your case presentation.

Once you have had an opportunity to review our written report, we will meet with the trial team to present the findings, answer questions, and discuss implications for trial strategy.  In addition, based on the juror profiles that emerge from the research, we will be in a position to develop a juror questionnaire and voir dire themes.
